NLRA Labor Law Poster Required For Private Employers

The National Labor Relations Board (NLRB) has issued the Final Rule requiring private-sector employers to post the NLRA Poster.  This notice requirement is effective January 31, 2012.  You may be asking yourself, “How does this affect my business?”  The bottom line is that private-sector employers and labor organizations whose workplaces fall under the National Labor Relations Act (NLRA) will be required to post the employee rights notice.  The posting requirement applies to all private-sector employers, excluding agricultural, railroad and airline employers.  In response to comments the NLRB had received after the proposed rule was announced, the Board has agreed to exempt the U.S. Postal Service for the time being because of that organization’s unique rules under the Act. The mandatory notice must be posted in the workplace in conspicuous locations where employees frequent.  Requirements outline the notice must be posted in English and in another language if at least 20% of employees are not proficient in English and speak the other language.  Additionally, employers who customarily post notices to employees regarding personnel rules or policies on an internet or company intranet site will also be required to display the notice on those sites.  Failure to post the notice may be treated as an unfair labor practice under the National Labor Relations Act.

The notice requirement is similar in nature to that of the NLRA Labor Law notice currently required for federal contractors.  It covers employees rights to act together to improve wages and working conditions, to form, join and assist a union, to bargain collectively with their employer, and to refrain from any of the activities.  There are examples of unlawful employer and union conduct and contact information for employees to file complaints and resolve questions.

This notice requirement has been in the works for over 8 months.  The Board received approximately 6,500 comments and accepted an additional 500 that arrived after the deadline.  Since this new requirement will have a far-reaching impact Compliance Poster Company invites your comments here or give us a call at 1-800-817-7678.
