Federal Contractor Compliance Made Easy

Understanding basic coverage and compliance information on equal employment opportunity laws and regulations which are enforced by the Office of Federal Contract Compliance Programs (OFCCP) doesn’t have to be complicated. The OFCCP enforces three (3) equal employment opportunity laws which include Executive Order 11246, Section 503 of the Rehabilitation Act, and the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).

Under Executive Order 11246, employers, federal contractors and subcontractors, must take affirmative action to ensure applicants and employees are not discriminated against based on race, color, sex, religion, or national origin.

Section 503 of the Rehabilitation Act requires federal contractors and subcontractors wit contracts in excess of $10,000 to take affirmative action to employ and fairly advance qualified individuals regardless of a disability.

Under VEVRAA, federal contractors and subcontractors that enter into a contract of $100,000 or more must take affirmative action to employ and fairly advance qualified covered veterans.

Moving on – It is important to be aware of some key complaint requirements:

When an applicant or employee of a federal contractor or subcontractor believes he/she has been discriminated against based on the above categories he/she may file a complaint with the OFCCP.  Did you know that an individual, organization, or group can even file a complaint on your behalf? If you feel you have been discriminated against based on sex, race, color, religion, or national origin your complaint must be filed within 180 days from the alleged discrimination. For complaints regarding disability or status as a protected veteran you must file within 300 days. Complaint forms (Form CC-4) can be accessed online and downloaded to your computer, click here.
