Smoking bans in the US are issued on a state-by-state basis. Bans are a product of state and local criminal laws and occupational safety and health laws, with Congress opting to stay out of the conversation. Carolina led the way in enacting a statewide smoking ban in 1995. Soon after, a number of states followed suit between 2004-2007.
While many states have enacted a smoking ban and added state and federal law posters, the extent to which the laws were issued varies from state to state. Some states ban smoking in specific areas, others prohibit smoking almost everywhere even outdoors.
The American Nonsmokers’ Rights Foundation states that more than 80% of the US experiences a smoking ban in “workplaces, and/or restaurants, and/or bars, by either a state, commonwealth, or local law.” The percentage of all workplaces and all bars that have a ban is less than 50%.
