San Jose Minimum Wage Hike Coming!

A ballot measure to raise the City of San Jose’s minimum wage has been approved by the voters.

San Jose, California employers will soon be required to pay employees no less than $10.00 per hour.

Posting and Notice: Employer’s must post the Minimum Wage Notice in a conspicuous place at any workplace or job site where any employee works. Every employer must also post the Notice in any language spoken by at least 5% of the employees at the workplace or job site. Additionally, employee’s must be provided in writing at the time of hire with the employer’s name, address, and telephone number.

Applicable Definitions:

Employee means any person who in a calendar week performs at least 2 hours of work for an employer.

Employer means any person, including corporate officers or executives, as defined in Section 18 of the CA Labor Code, who directly or indirectly through any other person, including through the services of a temporary employment agency, staffing agency or similar entity, employs or exercised control over wages, hours or working conditions of any employee or is either subject to the Business License Tax Chapter 4.76 of the Municipal Code or maintains a facility in the City.

At $10.00 per hour San Jose will have a minimum wage just below that of its neighbor San Francisco. San Francisco’s minimum wage rate will increase to $10.55 per hour also effective in the new year.

  1. I live in San Jose but work in Santa Clara I belive California should work as a state every one should have the same pay of $10 an hour min-wage how can we make this happen?


    1. The key is to urge California legislators to draft bills that address increasing in the minimum wage.


  2. is the $0.15 wage increase in San Jose California mandatory? I am getting only $ 10.00 an hour instead of $ 10.15 since January 1, 2014. And if mandatory can I collect the difference if I asked my employer? Please clarify.

      The Minimum Wage Ordinance was passed by City of San José voters on November 6, 2012. It required employers to pay their employees a minimum wage of $10.00 per hour for work performed within the City of San José and required the minimum wage to increase annually by the cost of living, if any, beginning on January 1, 2014. Effective January 1, 2014 the San Jose minimum wage rate did increase to $10.15 per hour.

      Beginning January 1, 2014, employers who are subject to the San Jose Business License Tax or who
      maintain a facility in San Jose must pay to each employee who performs at least two (2) hours of work
      per week in San Jose wages of not less than $10.15 per hour.
      The minimum wage requirement set forth in the San Jose Minimum Wage Ordinance applies to adult
      and minor employees who work two (2) or more hours per week (tips not included).
      Each year, the City will adjust the minimum wage based on the US Department of Labor’s Regional Consumer Price Index.

      Check with your employer to ensure (1) the employer is subject to the San Jose Minimum Wage and (2) that you the employee are working the specified minimum hours, etc, as indicated above.
