Procedural Change to Tennessee’s Workers’ Compensation Insurance Posting

Tennessee employers must now add a new procedure to comply with the Tennessee Workers’ Compensation Law. Upon a workplace injury, employers must provide the injured employee with an Agreement between Employer/Employee Choice of Physician (Form C-42). The form must include a list of at least three physicians, surgeons, chiropractors, or specialty practice groups in the employee’s community. If three or more of these physicians, surgeons, chiropractors, or specialty practice groups are not available in the employee’s community, the employer must provide a list of physicians that are located within a 100-mile radius. Employees may request reimbursement from the insurance carrier for travel expenses, if he or she travels more than 15 miles one way.

The employee must select a physician from the physician panel on the Agreement between Employer/Employee Choice of Physician Form, and sign the form. Employer must keep signed agreement on file, and provide copy to the employee.

Every employer subject to the Workers’ Compensation Law is required to display the Tennessee Workers’ Compensation Insurance Posting Notice.
