Maryland Releases Required Equal Pay for Equal Work Posting Update

All Maryland employers are required to post the updated 2015 Equal Pay for Equal Work workplace notice. The Maryland Equal Pay for Equal Work law requires an employer to provide equal pay to men and women who work in the same establishment and perform work of comparable character. The Equal Pay for Equal Work does not prohibit differences in pay because of a seniority or merit system, or because of differences in skills, abilities, job duties or work shifts.

The updated Equal Pay notice contains a new enforcement section 3-306.1 authorizing the Commissioner of Labor to investigate alleged violations of the law and attempt to resolve claims informally through mediation or request the Attorney General to take legal action against an employer on behalf of an employee or applicant, seeking injunctive relief, damages or other appropriate relief.  The new code section was added by 2013 Senate Bill 305. The Equal Pay law also authorizes an injured employee to file an action against an employer to recover double the difference in pay between male and female employees for the same type of work.
