Mandatory Changes to California Whistleblowers are Protected Poster

California’s Department of Industrial Relations (DIR) has released mandatory updates to the Whistleblowers Are Protected posting, the result of legislation enacted in 2013 that was effective this year.

Employees in California are encouraged to notify specified individuals when they have reason to believe their employer is violating state or federal statue, or violating or not complying with a local, state or federal rule or regulation. With the amendments, employees can now report violations to additional persons to include: a person over authority of the employee and another employee with authority to investigate, discover, or correct the violation or noncompliance, and to provide information to and testify before a public body conducting an investigation, hearing or inquiry. The definition of whistleblower has been expanded. As defined in the law, a “whistleblower can also be an employee who refuses to participate in an activity that would result in a violation of a state federal statute, or a violation of or noncompliance with a local, state or federal rule or regulation”. Finally, there is a change in code section from 98.6 to 1102.5 outlining employee job reinstatement conditions.

Compliance Poster Company’s HR Research and Compliance Team is working on updates to products and policies to reflect the mandatory changes.
