In California, there are a number of retirement living options for seniors age 60 and over. These facilities provide different levels of housing and residential services, care and supervision, assistance with activities of daily living, and incidental medical care in some cases. They include Continuing Care Retirement Communities (CCRC) and Residential Care Facilities for the Elderly (RCFE), also known as assisted living facilities.

These facilities have certain obligations to inform residents, relatives and visitors of residents’ personal and legal rights by providing them with written notice and posting a notice of residents’ rights under California law and regulation. Key posting obligations include:

  • California Health & Safety Code, Section 1771.7
  • Title 22 of the California Code of Regulations, Section 87468
  • California Health & Safety Code Section 1569.157

The statutes and regulation cover personal and social protections, environmental standards and accommodations, association rights, access to information and complaint procedures. The penalty for failure to post a required notice ranges from $50 a day to an assessment of $250.
