NEW CAL/OSHA HEAT REGULATIONS!
Essential Training Tool for all businesses & schools
The California Office of Administrative Law approved the EMERGENCY REGULATIONS proposed by Occupational Safety and Health Standards Board regarding Heat Illness Prevention on 8/22/05. These Emergency Regulations will remain in effect for 120 days expiring on December 21, 2005. In the meantime, the OSHSB will be submitting proposed regulations for “permanent” enactment.
The new regulations add §3395. Heat Illness Prevention to Title 8 of the California Code of Regulations. These regulations apply to all employees in outdoor work environments at those times when environmental risk factors are present. They include Provision of Water, Access to Shade, Training and Supervisory Training . Training is to include environmental and personal risk factors, procedures for recognizing signs & symptoms, evaluating and controlling exposure, importance of acclimatization, and the importance of water intake.
To assist employers with training and to reinforce the training, we have updated our Heat Stress Poster created in 2002. And while we did update the poster due to the new California regulations, it is excellent anywhere workers are exposed to HOT working conditions. CPC's poster covers:

Federal FACTA Disposal Rule!
The FACTA Disposal Rule effective June 2005! The Federal Fair and Accurate Credit Act of 2003 (FACTA) now require businesses and individuals to take appropriate measures to dispose of sensitive information derived from consumer reports.
Any business or individual who uses a consumer report for a business purpose is subject to the requirements of the Disposal Rule to prevent unauthorized access to or use of the information. The standard for the proper disposal of information derived from a consumer report is flexible, and allows the organizations and individuals covered by the rule to determine what measures are reasonable based on the sensitivity of the information, the costs and benefits of different disposal methods, and changes in technology. Although the Disposal Rule applies to consumer reports and the information from those reports, the Federal Trade Commission encourages those who dispose of any records containing personal or financial information to take similar protective measures.
The Disposal Rule is applicable to people and large and small organizations who use consumer reports such as: consumer reporting companies; lenders, insurers; employers, landlords, government agencies, mortgage brokers, car dealers; attorneys; private investigators; dept collectors, individuals who pull consumer reports on prospective home employees such as nannies or contractors; and entities that maintain information in consumer reports as part of their role as a service provider to other organizations covered by this rule.
To comply with the new Disposal rule for consumer report information, you can burn, pulverize, or shred papers in a manner that it cannot be read or reconstructed; destroy or erase electronic files or media containing consumer report information, conduct due diligence and hire a document destruction contractor to dispose of the material.
The Federal Trade Commission has issued a new publication, “New Rule Seeks to Protect Privacy by Requiring Proper Disposal of Sensitive Consumer Information at www.ftc.gov/bcp/conline/pubs/alerts/disposalalrt.htm, to educate businesses about the new requirements.
SEPTEMBER IS NATIONAL ALCOHOL AND DRUG ADDICTION RECOVERY MONTH!
The Federal OSHA newsletter has announced that September 2005 is the 16 th Annual National Alcohol and Drug Addiction Recovery Month! Timing is everything… In our August “Making Compliance News” we featured the article “Drugs in the Workplace” on alcohol and drug abuse in the workplace.
It is the hope that employers will participate in this campaign. Recovery Month is an opportune time for employers and employees to work together to reinforce that being safe means being drug free, and that, for those with alcohol and drug problems, there is help. The U.S. Department of Labor's Working Partners program offers ideas about ways employers can contribute to the success of the campaign.
