DANGERS OF HEAT STRESS IN THE WORKPLACE!
The heat is coming! Do you know the dangers your workers face as the temperatures rise?
Summer presents unique health hazards to those who work outdoors or in very hot environments. Although OSHA has no specific regulations regarding heat stress, the “general duty clause” states “Each employer shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees;”

The combination of heat, humidity and physical labor can lead to fatalities. The two most serious forms of heat related illnesses are heat exhaustion (primarily from dehydration) and heat stroke, which could be fatal. Signs of heat exhaustion or heat stroke need immediate attention. Recognizing those warning signs and taking quick action can make a difference in preventing a fatality.

CALIFORNIA’S NEW REQUIREMENT FOR SEXUAL HARASSMENT TRAINING

WHAT COMPANIES MUST PROVIDE THE TRAINING?
If you are an employer with 50 or more employees, you are covered by the California’s new Government Code Section 12950.1. This requires that you provide AT LEAST two hours of training and education regarding sexual harassment to your supervisors.

WHAT KIND OF TRAINING MUST BE PROVIDED?
The training must consist of “classroom or other effective interactive training and education.” The trainer will have to rely heavily on examples, role-plays, group discussion and questions and answers.

CAN YOU DO THE TRAINING IN-HOUSE?
The new law requires that the training be conducted by “trainers or educators with knowledge and expertise in the prevention of harassment, discrimination and retaliation.”

It is unlikely that the average human resource manager will have the background necessary to conduct the required training and to answer the challenging questions that might arise.

WHAT KINDS OF TRAINING WILL CPC SEMINARS PROVIDE?

Option 1 – Training Seminars
For the smaller companies with less than 10 supervisors, a training seminar will probably be the best option. These seminars will be presented for groups of up to 30 participants with a number of different companies sending their supervisors.

All training materials will be provided and a certification of completion will be issued to each attendee.
Cost - $95.00 per person

Option 2 -- In-House Training (This is our most popular option by far!)
One of our trainers will come to your company and provide the training on-site. This saves travel time for your supervisors and has the advantage of allowing you to schedule the training at a time that has the least impact on your regular operations. Our trainers are flexible, and with advance notice, will train early mornings, late afternoons and evenings and even weekends.

Cost - $600 for non-customized training
$900 for customized training, including review of your company policies and procedures. Travel time will be added to training cost depending on the company location.

Option 3 – Deluxe Training
This training will also be conducted at your location. It will be co-trained by attorney R. Craig Scott and Stewart Lerner, co-authors of the publication, Sexual Harassment: Training and Investigation.

This package also includes a legal review of your company’s harassment policies and procedures and customization of all materials to reflect your company guidelines. In addition, we will prepare an introductory speech for the President/CEO of the company.
Cost - $2000

DEADLINE FOR COMPLETION OF TRAINING
Remember! All supervisors on your payroll, as of July 1, 2005, MUST be trained by January 1, 2006. As the year moves on openings for scheduling training will fill quickly. Contact CPC right away to reserve a time that best meets your needs.

FINDING A RELIABLE SUPPLIER

I just read that Toyota was once again named the most reliable brand of car in the world by Consumer Reports. This certainly is one reason why Toyota has become the 2nd most popular brand of car in the world. What has led to their outstanding record? Excellent design, research, production, quality control, communication, and a great track record, just to name a few elements. These are the same things you should look for in a supplier of labor law compliance materials, since a mistake in compliance can cost you far more than a typical car repair.

To best protect your company, you should make sure you are dealing with a supplier that has proven its reliability. To that end, here are some questions you should ask of potential suppliers before you buy:

  1. Are the posters researched, designed, manufactured and shipped “in house”?
    This represents the best chance that you can contact a representative that can actually help resolve a problem. If you are dealing with a 3rd party distributor, or a firm that outsources their research and design, problems can take far longer to resolve.

  2. Does the supplier have a physical business address and not just a PO Box or residential address?
    Most dot.com companies and home-based poster suppliers are "virtual" companies with no support. For true piece of mind, deal only with manufacturers of top quality compliance products.

  3. Does the supplier have an infrastructure to handle large shipments to multiple locations
    Companies without this ability can cause delay in your shipment, order confusion, difficulty in tracking your shipments, and invoicing problems-, all of which cost you money. Verify the shipment capabilities of your potential suppliers before placing large orders.

  4. What kind of track record does your potential supplier have?
    Check a company’s Better Business Bureau Report to verify the facts at BBB online.

  5. Is the supplier a fully licensed business?
    Beware small distributors without business licenses. Don't fall victim to a fly by night operation that leaves you hanging when you need them the most.

  6. Does the supplier have a "Disclaimer" for your review?
    Although some companies offer guarantees, some nullify that guarantee with a "Disclaimer". The disclaimer often states that the company is not responsible for the accuracy of the poster content nor for the posting compliance requirements. These "Disclaimers" are frequently well hidden on their websites or in their contracts. You should trust companies only if they are willing to stand behind their product accuracy.

  7. Will a “Compliance Certificate” protection plan protect my company from fines?
    Always read the fine print! Companies that offer these "protection plans" often promise they will automatically send you new posters as the laws change for "no extra charge". To determine if this is a good value for your company divide the cost of the "subscription" by the number of years they guarantee to replace the posters. You will find they are generally charging you one and one half times the price at which you can purchase a replacement poster each time the law changes. What about the years when there are no changes in your state? Do they refund the money? Read the fine print on these "protection plans"- they are generally a huge profit center for labor law compliance product suppliers.
