EMPLOYERS FACE POSSIBLE LAWSUITS FOR FAILING TO POST CURRENT LABOR LAWS!

Imagine PAYING your employees if you inadvertently violate the labor code!

Unbelievable as it may sound it is true! Now employees may assess and collect penalties for violations to the Labor Code. A recent press release from the Coalition for California Jobs stated that California lawmakers have passed SB 796.  This bill gives aggrieved employees or former employees the right to file lawsuits that may allege any type of Labor Code violation, including minor or inadvertent labor code violations such as not posting the state mandatory postings.

 

This can result in a penalty ranging from as much as $52,000 to $156,000 for failure to have the correct wage-and-hour poster on the wall depending on the length of time the violation existed.

Another law signed into effect this year that will affect your posting requirements is the passage of SB777, the Whistleblowers Law.  This law will require a NEW posting for California employers.  Other legislative changes also require revision to the following mandatory postings: Workers’ Compensation, EDD Unemployment and Disability (new Paid Family Leave law), and the Harassment and Discrimination posting.
