North Dakota Passes Paid Time Off and Pregnancy Discrimination Laws

North Dakota Labor Law PosterThe North Dakota Department of Labor and Human Rights has released a new Minimum Wage and Work Conditions Summary posting. During North Dakota’s 2015 legislative session, several labor laws were passed, including two laws that caused major revisions on the Minimum Wage and Work Conditions Summary posting. The revised posting includes a new list of paid time off limitations and a new protected class against discrimination.

Under enacted Bill H 1202, private employers awarding paid time off, are authorized to withhold payment if employees separate from employment, and:

  • Paid time off was not yet earned, and
  • When a written notice of the limitation on payment of awarded paid time off is provided to employees before being awarded paid time off.

The second enacted bill (H 1463) makes it unlawful for employers to refuse to hire or fail to provide pregnant employees with reasonable accommodations. However, employers are not required to provide accommodations if these impose undue hardships or disrupt or interfere with employer’s business hours.
